Below you will find our general purchasing terms and conditions. By using our service, you are deemed to have accepted these Terms which form the basis of all transactions between us and you. If you do not agree to these Terms, please do not engage in our service.
These Terms and Conditions form part of the agreement between TradeNow Australia Pty Ltd ABN 87 172 394 314 (“TradeNow"), and you, the customer (“Seller”). They apply to the terms of payment and submission of your electronic device. By submitting/ sending your electronic device to TradeNow you are agreeing to accept these terms and conditions. TradeNow is not owned, operated or controlled by Yoogalu Pty Ltd ("Harvey Norman"), any related body corporate of Harvey Norman or any entity operating a franchised business under the 'Harvey Norman'("Franchisee"). Under this agreement, TradeNow is the purchaser of your phone, laptop, tablet or technology ("Relevant Good"). Each of Harvey Norman, each subsidiary of Harvey Norman and each Franchisee is not a purchaser of the Relevant Good. A Franchisee, or an employee of a Franchisee, may assist you to sell your Relevant Good to TradeNow. Any Assistance provided by a Franchisee or any employee of a Franchisee is not provided by the Franchisee or the employee of a Franchisee as an employee, agent or contractor of TradeNow.
These Terms and Conditions refers to a situation in which TradeNow acts as a buyer. TradeNow acts as a registered company, that manages and maintains the tradenow.com.au trade platform. The Seller can be either a private person or a company.
The Seller sells their device(s) and any original accessories of their choosing (charging cable, power supply, data cable etc.) (“Product”). TradeNow has offered a certain price (“Offer”) for the Product based on the product- and condition specifications given by the Seller and any original accessories included in the sale. Condition classes are defined as follows:
The Product must not have cracks, fractures or engravings. The power supply has to be intact, and the charging cable’s protective sheath must not be damaged. The charger must have an AU plug.
A Brand New (0-6 months) or unopened Product must be sent to us with a copy of its original purchase receipt.
After having Accepted the Offer, the Seller delivers the Product by post with the prepaid consignment information provided by TradeNow.
The prepaid consignment note will be sent to the email address provided by the Seller after the acceptance of the offer. The Product must be received by TradeNow within 10 days of acceptance of the sales order.
The Seller is responsible for proper packaging of the Product and assumes all the risks of the delivery until the Product has been received by TradeNow. The Product must be sufficiently protected by proper wrapping and cushioning. In the case of Apple devices, the “Find my iPhone” function must be turned off before delivering the Product.
If the Product is enrolled into a Mobile Device Management (MDM) system, the Product must be disconnected thereof before sending the Product.
TradeNow informs the Seller via email when the Product has arrived and been received.
When the Product is delivered to be checked, the Seller guarantees that:
TradeNow Pty Ltd shall not be liable for ramifications or expenses in situations in which the Seller has breached the above guarantees.
After the Assessment (approximately 2-5 business days), the Offer will be confirmed (Confirmed Offer). Should the Confirmed Offer be the same as the Original Offer, the purchase of the Product shall proceed to payment phase without further notice. If during the assessment process it is determined that the Product’s condition deviates from the Seller’s declaration, or the Product has other defects or deficiencies, the Original Offer may be adjusted (“Adjusted Offer”). The adjustment may be required due to, for example, the Product’s cosmetic condition deviating from that which the Seller has declared, a component malfunction, or other similar defects. Additionally, should the Product’s battery not pass our official battery test, or if the original and correct accessories, for example, the adaptor, power extension cable, or AU wall adaptor plug are missing or damaged, without prior notice, the original Offer may be adjusted.
The Seller is responsible for data backup before delivering the Product. SIM-cards and used screen protectors will be disposed of during the check-up process.
If the Product is bought at the Confirmed Offer, or the Seller has agreed to the Adjusted Offer, TradeNow will pay the price agreed upon via the method chosen by the Seller. The payment will be processed within two business days from the confirmation of the Confirmed Offer or the acceptance of the Adjusted Offer. Once the payment has been made the device is legally the property of TradeNow.
If payment is made via PayPal and the provided PayPal account is set to a currency that requires a currency conversion fee, this fee will be deducted from the payment.
TradeNow retains the right to withdraw from the sale of goods unilaterally and without compensation until the payment has been processed. The Seller will be informed of the possible cancellation via email. Should the sale of goods be cancelled, TradeNow will deliver the Product back to the Seller via the original delivery method to the original address provided. The return address has to reside in Australia.
These Terms and Conditions of Sale enter into force, when the Seller has electronically accepted these Terms and Conditions by pressing a specific “Complete and Trade” button during the sales offer process at tradenow.com.au and when TradeNow has accepted the Seller’s offer request and sent them an initial offer confirmation email.
